(中央社記者游凱翔台北21日電)台北市政府認為大巨蛋未按圖施工,去年祭出停工處分,遠雄提起行政訴訟並要求撤銷處分。台北高等行政法院今天裁定不應全面停工,為防範坍塌危險,必須先完成適當措施。
台北市府去年5月20日勒令大巨蛋停工,遠雄公司為了提早復工,7?a href="http://chalet.8193.com.tw/">可移動木屋?日在北市府的「最後通牒」前,以豪雨、颱風影響工地安全為由,向台北高等行政法院聲請停止執行停工處分。
今天裁定結果出爐,台北高等行政法院裁定遠雄大巨蛋可部分復工,並完成適當的工地安全措施。
北高行指出,大巨蛋工程停工後,地下水位上升、已完成的工程多處鏽蝕為不爭的事實,若遇強震、強颱可能發生公安風險,危害民眾生命安全,因此依行政訴訟法規定裁定停止執行原本的停工處分。1050721
